Advice on car accident...solicitors letter has come...help!?
My friend at work was in a car accident recently. She hit a workman's van and caused damage to both vehicles. However, the van was parked really dodgy; half on the pavement, half on the road, on a very steep hill, and parallel to another vehicle parked on the other side of the road. So there wasn't much room to get through. Now she has received a solicitors letter from his solicitor, saying that she was clearly negligent and that she should contact her insurance company for advice. Clearly this guy intends to get every penny that he can My question is this: Can someone claim from your insurance AND sue you personally i.e. do you twice? She is worried that he will privately sue her for lots of money. Thankfully the workman was NOT in the van, so at least he can't claim injury.

car accident solicitor advising 50/50?
I was involved in a minor car accident last year, i was travelling down a main road when a car pulled out from a give way, the car travelling in front of me turned left into the give way and a lady pulled out to turn right presuming she had enough time to get to the other side of the road, from the start of the claim everyone has said its very black and white and clearly not my fault, the lady is now claiming i overtook the car in front of me, if i did which i did not this would then put us both at fault as overtaking at a junction and coming out of a give way are both incorrect. I have a video showing the lady over the give way lines, so there is proof she is in the wrong, she is admitting she was at fault but also that i was? i did not overtake the car in front but there is no proof that i didn't, my insurance want me to settle 50/50 or i can go to court but if i loose or don't get 50/50 by a judge i would have to pay costs? has anyone been forced into 50/50 and do you think it is a regular occurrence from solicitors?
