What happens if a driver hits a pedestrian whilst on a mobile phone?
I keep seeing drivers using mobile phones whilst driving up and down my street. What would be the legal position, say if a pedestrian was hit by a driver whilst on a mobile phone? What's to stop pedestrians or other drivers deliberately throwing themselves on to moving vehicles/crashing into drivers who can be seen on their mobile phones, and then faining some kind of whiplash/injury and claiming compensation? (UK only please)

A company I worked for was closed down in 2008 and all assets were frozen and put into receivership with a managing receiver. The company owed it's employees salary's and back dated holiday , but technically couldn't pay it and neither would the managing receiver. The employees formed a group and collectively we took the Company to Industrial Tribunal Courts and we all won our cases. The court issues a warrant for our claims to be paid and the originals went to the company whilst copies were also sent to the Managing Receivers. Now 3 years later the company directors have pleaded guilty to carouselling and according to trade paper reports the employees can claim for compensation for redunancy / unpaid salaries via the Proceeds of Crime Act. Does anyone know how do I go about claiming, or will our original Industrial Tribunal case files already be in the process already?
