3rd Party Suit vs Michigan Bankruptcy?
I was involved in a motorcycle accident coming up on 3 years ago.....long story short, were approaching the end of a long road, my attorney has encouraged me to a arbitration hearing instead of going through a jury trial.....and we discussed the 3rd party suit against the actual person that hit me. He said that it might not be worth the hassle to pursue the 3rd party suit, because if we get a judgement against the person that they would probably turn around and file bankruptcy????? I wasn't aware that a person could file bankruptcy against a injury accident.....and if that is the case, if I have a judgement in my favor, and the person files bankruptcy, can I place liens on his personal property, home, etc......thanks for any advise you can offer me.

Arbitration or Jury Trial?
I was involved in a injury accident (victim), after almost three years and two surgeries with permanent nerve damage and continued physical therapy my attorney contacted me and said that the defense wanted to offer us a Arbitration Hearing. It was explained to me that we would appear in front of a panel of three attorneys, one would be chosen by the defense and one from my attorney and one by myself which of course my attorney would choose. My attorney said that he felt a arbitration would be the best bet because if we went with a jury trail, that it could go against us because of race or possibly someone on the jury my had been in a accident before and has hard feelings so they wouldn't award us much, etc.....plus the additional cost for getting the depositions from my Dr's, etc. He also explained that what ever decision the attorneys made is set in stone, and once we're awarded that it doesn't take as long to receive payment.....any advise?

I have to make a statement to insurance company regarding accident?
Almost 8 weeks ago, I was in an accident where I did not notice a work truck coming and pulled out in front of me and he hit me. My car was totaled and his truck mainly had scratches. Yesterday, he filed a claim with my insurance company. They left me a voice message saying they needed for me to make a statement. What questions do they usually ask for this?
