My brother had his foot ran over one year and four months ago. What is the liability of the driver?
My brother was with some friends at a bar late one night about a year and four months ago. He and his friends went outside to have a smoke (No smoking in the bars in Iowa). Apparently there is an alley way where they were standing (or close to it) and a person leaving ran over his foot. The driver didn't stop and went home. The cops were called and when they went to this persons house the guy said he didn't run over his foot. He says he was leaving the bar and the next thing he knows these people are banging on his truck and he got very scared and got the hell out of there. The cops took statements but didn't issue any tickets. My brother has some witnesses, his friends, and hired a personal injury lawyer. After several months of not hearing anything from his lawyer he went to visit him today. The lawyer said that the insurance agency has requested a statement and he is sending it over to the insurance company this week. I would like to know if this is normal to just be issuing a statement to the insurance company a year and four months after the fact and what the realistic liability this driver has. He still claims he didn't run over my brothers foot. It was late at night and people had been drinking and they were standing outside close to a dark alley/ parking lot. The cops said this man wasn't intoxicated and took a statement but refused to issue any tickets. My brother went to the hospital and had damage to his foot but I am wondering because of the failure by the police to issue the driver a ticket if this is a statement by the police saying they aren't buying that this guy ran over his foot. If they did believe it I would think they would have issued a hit and run ticket, which is a pretty serious offense, at the very least. So I guess my question is a two fold one. Is his lawyer, who is one of those only gets paid if he wins a judgment lawyer, sees this as a waste of time and that's the reason for this statement to have not been sent over yet and what is the liability of the driver? How hard is it going to be for my brother to collect some compensation for this injury with these circumstances, like the at a bar late at night, outside smoking near an alley when it's dark,and the denial by the driver and no issuance of tickets by the police.My brother seems to think that he will have no problem collecting a settlement from this guy or his insurance and I think he is going to have trouble, especially with the no issuance of tickets to the driver. Also, what is the likely probability that the insurance company is going to pay his medical bills and pain and suffering without an in court fight? The statute of limitations in Iowa for this type of injury is two years and it has already been a year and four months. Is it going to be a tough time for him?

I was laid off so my husband was forced to find another Job we went to her with the days that we were going to pay the rent she had no problem with it and said just to contact her attorney to amend it . On the 9 of this month we hear from the attorney saying nothing will be amended and she will not take the rent and for us not to contact her anymore, I know why she is doing this now because on the 8th she got a letter from my daughters personal injury lawyer that her insurance is being sued, so no she wants to evict us! She has a corporate office Do I try to speak to them? What can I do? Do I have any rights? I live in Florida. Can anyone please help me we have 6 kids and this is all we have and have lived here for 7 years

Can I just get corporate to take it?
